Ms. Nguyen Thu Hang (Bac Giang) as director of a company. The company has suspended operations on 5.1.2012 until 01.05.2015 but social insurance for employees. From day 01/01/2016 Hang and some other employees transferred to employees in a new company.
Ms Hang said, she can switch to a new company SI is not? If yes, what do these procedures?
In this regard, Vietnam Social Insurance Hang replied as follows:
As stipulated in Points a, h, Clause 1, Article 2 of the Social Insurance Law of 2014, employees working under labor contracts from the period of 3 months or more; Managers can now enjoy salaries are subject to compulsory social insurance.
Thus, the case of Ms Hang and some other employees transferred to work in the new company under labor contracts with a term of full three months or more, compulsory social insurance in the new unit.
Social insurance procedures in new units comply with the provisions in Decision No. 959 / QD-SI dated 09.09.2015 of the General Director of the Vietnam Social Insurance.
